of articles related to the enforcement
of foreign judgments in the Syrian Code
of Procedure Legislative Decree No. 84
of 1953
Section V - Enforcement of foreign
judgments (Articles 306-311)
Article 306
An order of enforcement of foreign
judgments in Syria can be granted on the
same conditions set for enforcing Syrian
judgments in that foreign state.
Article 307
The request for enforcement of the
judgment is to be filed with the court
of first instance that has jurisdiction
in the place where the enforcement is to
take place.
Article 308
An order of enforcement of a judgment
can only then be granted, when the court
has verified that:
A judicial body having jurisdiction
according to the law of the state where
it has been rendered has passed the
judgment. The judgment must be final
according to the law of the same state.
The parties have been duly served with a
writ and have been represented in a
correct manner.
The judgment is not irreconcilable with
a judgment given in Syrian Courts.
The judgment is not in contrary to
ethics or to the ordre public in Syria.
Article 309
With respect to the previous articles,
arbitration awards rendered in a foreign
country can be granted enforcement in
Syria when they are final and
enforceable in the country where they
were rendered.
Article 310
With respect to the previous articles,
an order of enforcement can be granted,
when the official documents, which are
enforceable in a foreign country, are
final and enforceable in the country
where they were made.
The request for enforcement is to be
filed with the court of first instance
that has jurisdiction in the place where
the enforcement is to take place.
The order of enforcement can only be
granted, when it is established that all
requirements for the document which are
required to be official are met
according to the laws of the country
where they have been made and that they
do not contain anything which is in
contrary to ethics or to the ordre
public in Syria.
Article 311
The application of the above mentioned
rules should not breach the treaties
concluded between Syria and other
countries in this respect.
